We often do things of fail to do things that get us in legal trouble. One of the reasons we often get in legal trouble is that we fail to think about the possibilities. We fail to think about all the things that could go wrong and only look at the positive things. One of the best ways to prevent keep out of legal problems is to plan ahead.

Preventing things from happening is a good way to keep out of trouble. This means a little more work than usual, but is very effective. A big area of litigation that clogs the courts and takes an awful lot of court time, so much so, that judges are annoyed is landlord tenant disputes. Often it arises when a room is rented it out. The scenario is repeated over and over again and for some reason or other, landlords seem to repeat the same mistakes. This occurs often when the landlord fails to do a background check.

Some landlords fail to take the time to ask the most simple of things, such as where do you work and how much do you make. If your prospective room mate is not working, chances are you will not get paid. Another thing a landlord can do is check the prospective room mates criminal background, the last thing you want is a room mate that is dealing drugs out of your home that is no paying the rent and that you can not get rid of. This scenario occurs much too frequently. You do not need to spend a lot of money or time to do a basic background check. First ask about where the prospective room mate has lived during the last five years and to list the cities and addresses, then get your prospective room mates name and date of birth from his or her id. Then go the internet and find the court for the counties where the prospective room mate has lived, in some cases you will be surprised to see that your prospective room has criminal record.

Personal attacks, theft of your valuables, wrongful death claims, criminal charges often arise when you bring a stranger into your home. It is not so much that it is a stranger, but the fact that a criminal has entered your home and you now know a criminal. For the most parts crimes are committed by someone the victim knew. There is recourse for such things as a wrongful death claim and you can hire a wrongful death attorney, but if you bring a broke criminal into your home a victory for such things as personal injury or wrongful death would be completely devoid of any satisfaction. Criminals for the most part have no financial stake in anything and therefore it is easier to disobey the law and commit a crime for these individuals.

When you are renting out a room and really regard the tenant as your room mate, keep in mind that the landlord tenant law still applies. You can not just tell the room mate that fails to pay the rent to get out. You have to evict the room mate, this means you have to file a lawsuit for unlawful detainer, you have to serve a three day notice to pay or quit, you have serve him or her with the lawsuit, and you have to go to a trial or default him or her.

It is complicated paper shuffling which can result in a dismissal by the judge for a real technicality, and then you have to start all over. By the time you get a court order to vacate the premises, you would have incurred the added expense of perhaps three months no rent, the filing fees, the service of process fee and other miscellaneous fees. If you have children you may have also exposed your children to terrible role model and unnecessary danger. Also, you may later find that your valuables are missing.

This no guarantee you will have no problems if take precautionary measures, but a simple criminal background and simple application is a cheap effective way to safeguard your credit, your personal belongings, and your sanity.
