Dog Bite Liability
Liability for dog bites in California is strict liability. What this means is that if you are bitten by a dog while you are in a place where you have the right to be, then the owner of the dog is liable. Meaning you only have to prove who owns the dog. You don’t have to prove the owner did anything wrong. There are no free bites in California, if the dog bites you are liable Other states have similar statutes, but some have free bite laws. This does not apply if the person does not have a right to be where the bite occurs. If a burglar breaks into a home and gets bitten, the strict liability does not apply, because the burglar did not have a right to be there. |
