Slip and Fall Injury Claims

One of the most common accidents is slip and fall accidents. These accidents regularly occur because of wet floors. Virtually every store has customers slip and falling every day. The primary reason is due to a substance that falls on a smooth floor. The vast majority of the time the accident occurs as a result of the negligence of an unidentified party. Someone other than store employees drop food, drinks, or water on the floor and then someone steps on it. The injured then wants to file a lawsuit and is surprised to learn that the vast majority of experienced attorneys are not interested in pursuing such a claim.
Attorneys take few slip and fall cases, because a store is not an insurer. The store has a duty to act reasonably and if they regularly clean their floors or clean spills after someone reports the incident, then they have acted reasonably. If there is a big spill five feet in front of a cashier and no one cleans it for 30 minutes and someone falls, chances are that a jury would find that unreasonable. The test is one of reasonableness and more often than not the store is reasonable in taking measures to insure a safe floor. Sometimes the store operator cheats by keeping false records, but in such instances, unless one of the employees is prepared to testify that the store is not regularly swept, the injured stands little chance of winning.
